Your privacy is our business. Foxway protects your privacy by making sure to collect and handle personal information in a responsible way. Our privacy policy takes dives deep into exactly how Foxway collects and uses your personal information. It’s highlighting your rights when it comes to personal data and how you can argue your rights. 

”Foxway”, ”we” ”our”, or ”us” refers to Foxway AB registered with the Swedish Companies Registration Office. Our organization number is 556470-0309 and our head office is at Grusåsvägen 7 in Växjö, Sweden. In accordance with EU data protection legislation, we are responsible for the personal data that you provided us with, or that we collected from you. All processing of your personal data by Foxway is done in accordance with applicable data protection legislation.

Who is responsible for your personal data?

Foxway is responsible for the personal data collected and processed by us and our subcontractors within the framework of our services (the “Foxway Services”) and for the processing of personal data through our digital channels, such as this website and/or other future digital touchpoints.

Kinds of personal data processed

Personal data is information which helps to identify a person and therefore information that can be led back to a person. It includes name, telephone number, address, e-mail, username, profession and purchase history. Foxway also use cookies so that you do not have to log in every time you visit our website for example. More detailed information on how we use cookies can be found under the section ”Cookies” below. Please note that information about purchase history in relation to a specific corporate customer is linked to the corporate customer, and not to you as a contact person.

We can also collect person data from your device that can tell us if you are browsing from a computer or mobile phone and the browser that you are using. We also collect data on how you use Foxway Services, information about the features you use, the websites that you visit and the software configuration that you use. This may also include information about IP address and settings.

How do we collect your personal data?

We collect personal data when you use Foxway Services or in any other way interact with us. The data is collected through the following procedure:

Information that you share with us. When you register yourself as a user/customer, log in to our website and contact our customer service for support. When you sign up for our newsletter, one of our events, apply for a job with us or perform other activities within the framework of the Foxway Services when providing information about yourself, such as name, phone number, email address and content of messages. Personal data is usually provided by you actively providing us with filled out online forms, send emails or give us feedback through features created for that purpose. 

Some personal data is collected by analyzing the way you interact with Foxway Services and our products, such as website cookies and information (IP address, language settings and push notification settings) that we get from the way you use your device (mobile phone, computer or tablet) when using Foxway Services. 

What do we do with your data? 

The reason for processing personal data is to improve the Foxway Services for you. That we have the opportunity to (1) provide and administrate your access to Foxway Services, (2) fulfill our contractual and legal obligations, (3) to answer customer service issues, (4) improve your user experience, (5) send you information and direct marketing through email or any other way, (6) further develop the Foxway Services and (7) prevent, limit and investigate misuse of Foxway Services. 

The processing of personal data in accordance with points 1 to 3 above is done with fulfillment of an agreement as a legal basis (if the processing is necessary to fulfill our contractual obligations to you) or a legitimate interest. The processing of personal data in accordance with points 4 to 7 above is done with a legitimate interest as a legal basis, where Foxway’s legitimate interest is to be able to exercise its rights and obligations under the agreement with the customer company and to market our products and services.

How long do we store your personal data?

Foxway will take reasonable steps to store personal data only for as long as necessary in order to fulfill the purposes of which it was collected in the first place. Otherwise we will delete personal data in accordance with applicable law. We store your personal data for as long as it’s necessary for us to be able to fulfill our commitment, i.e. provide Foxway Services, invoice or handle complaints. If you have agreed that your contact information should be stored in our client register for marketing purposes, it will be stored up to 36 months after customer relationship has ended if you don’t request your personal data to be deleted before then.  

Who can we share your information with?

Foxway may share your personal data to partners who perform services on behalf of Foxway. These recipients only have the right to process your personal data in connection with performing a service for Foxway, e.g. to deliver an ordered item to you or to send marketing or newsletters. We require these providers to protect your personal information in accordance with this Privacy Policy and not use or disclose your personal information for any purpose other than to provide us with agreed products or services. We may also disclose your personal information to authorities, such as the Swedish Tax Agency, if we are required by law to do so. In the event that all or part of our business is sold, we may share your personal information to a potential buyer of the business.

Transaction to third countries

Foxway primarily processes personal data within the EU/EEA, but in some cases, use suppliers that are established in a third country (i.e. a country outside the EU/EEA), for data storage, and system maintenance that gives the supplier access to personal data. In the event that data is shared to suppliers in third countries, this will only happen when Foxway has legal support, e.g. by signing the European Commission’s standardized model clauses. Foxway will also require these providers to (1) protect your personal information in accordance with this Privacy Policy and (2) not use or disclose your personal information for any purpose other than to provide us with agreed products or services.

Security

Foxway takes all appropriate security measures necessary to protect your personal data from unauthorized access, alteration or destruction. However, it always involves a risk of disclosing personal data via digital channels as it is not entirely possible to protect computer systems from intrusion.

Your rights

You have the right to contact Foxway at any time in order to exercise your rights under applicable data protection laws.

The right to access extracts and correction: You have the right to request information free of charge once every calendar year about which (if any) personal data we process about you and also have any incorrect information corrected.

The right to be forgotten: You have the right to request the deletion of your personal data in the event that the data is no longer necessary for the purpose for which it was collected (the right to be forgotten). Depending on which data that gets deleted, Foxway may no longer be able to provide certain services to you.

The right to information: You have the right to receive information about how your personal data is processed. This is done through this Privacy Policy.

The right to limit the processing of your personal data: You have the right to limit the personal data. In such a case, the processing of your personal data may only take place for certain limited purposes.

Right to object against Foxway’s processing of personal data: You have the right to object to Foxway’s processing of your personal data under certain conditions. The right to object applies to e.g. if the processing is based on a balance of interests, unless we can demonstrate (1) compelling legitimate reasons for the processing that outweigh your interests, rights and libirties, or (2) if the processing takes place for the determination, exercise or defense of legal claims.

Right to object to marketing: You have the right to object Foxway’s processing your personal data for marketing. If you object to this, Foxway has to discontinue all marketing to you without undue delay. 

The right to data portability: You have the right to request a copy of the personal data you have provided to us in a structured, common and machine-readable format. You also have the right to request that Foxway share this personal data to another personal data controller. The right to data portability applies to personal data that is processed in an automated way, which is based on your consent or through an agreement to which you are a party.

External links

In our digital channels, there may be external links to other websites provided by other companies outside the Group. This privacy policy does not apply to these websites and you should therefore read the privacy policies of those websites before disclosing personal information.

What are cookies?

Cookies are small text files that are sent from our web server to be saved in your browser when you visit our website. The reason behind cookies is to improve your experience of our website. Functional cookies make it possible to save information that can change the appearance or functions of the website. In our forms on the website, we use the third-party tool Hubspot. Statistical cookies

Statistical cookies make it possible for Foxway to understand how our visitors interact with the website. We use Google Tag manager as a statistics tool for our website. Foxway uses it to be able to see the number of visitors to the website, where the visitor comes from and which sites have been visited. The information collected is anonymous.

Marketing cookies

Marketing cookies are used to track visitors cross-border on websites. These cookies contain information about how you interacted with our website. For example, which pages you visited and the links you clicked on. Our purpose is to show ads that are of interest to the individual user and that are more valuable to Foxway and third-party advertisers. Foxway uses targeted ads via the Google Marketing Platform, Facebook, instagram and Linkedin.

Foxwayn tietosuojakäytäntö sinulle Samsung Flex -käyttäjänä

1. Johdanto

Tässä tietosuojakäytännössä kuvataan, miten käsittelemme henkilötietojasi Samsung Flex -ohjelman (”Ohjelma”) tarjoamiseksi, kun olet yhteydessä meihin tai johonkin yhteistyökumppaneistamme liittyen Ohjelmaan. Täältä voit lukea lisää siitä, mitä henkilötietoja keräämme, miten ja miksi käytämme henkilötietojasi ja miten voit käyttää oikeuksiasi.

Ohjelma on Foxway AB:n, Grusåsvägen 7, Växjö (556470-0309) (”Foxway”, ”me”) ja Samsung Electronics Nordic AB:n, Torshamnsgatan 48, Kista (556445-4345) (”Samsung”) välisen kumppanuuden kautta tarjoama palvelu, joka koskee mobiililaitteiden (”Laite”) vuokrausta ja ostoa Ohjelman puitteissa. Foxway ja Samsung ovat yhteisrekisterinpitäjiä koskien Ohjelman puitteissa tapahtuvaa henkilötietojen käsittelyä. Foxway on ensisijaisesti vastuussa Ohjelman tarjoamiseen ja hallinnointiin tarvittavien henkilötietojen käsittelystä. Samsung on ensisijaisesti vastuussa sellaisesta henkilötietojen käsittelystä, joka on tarpeen sovitun käyttäjätuen tarjoamiseksi ja muiden laitteistoon liittyvien ongelmien ratkaisemiseksi.

Voit minkä tahansa henkilötietojesi käsittelyä koskevan kysymyksen osalta kääntyä kummankin yhtiön puoleen. • Mitä henkilötiedot ovat?

Henkilötiedoilla tarkoitetaan kaikkia tietoja, joiden avulla sinut voidaan tunnistaa, kuten nimesi, henkilötunnuksesi, osoitteesi, puhelinnumerosi tai sähköpostiosoitteesi.

• Miten käytämme henkilötietojasi?

Voimme käyttää henkilötietojasi seuraaviin tarkoituksiin.

• Ohjelman tarjoaminen. Meidän on käsiteltävä tiettyjä henkilötietoja, kuten nimeäsi, sosiaaliturvatunnustasi ja yhteystietojasi, jotta voimme toteuttaa kanssasi tekemämme sopimuksen Laitteen vuokraamisesta.
• Laskutus. Käsittelemme nimeäsi, henkilötunnustasi ja yhteystietojasi, jotta voimme lähettää sinulle laskut sopimuksen mukaisesti.
• Kommunikointi ja käyttäjätuen tarjoaminen. Käsittelemme yhteystietojasi ja tietoja, jotka luovutat meille kommunikoidessasi kanssamme, jotta voimme käsitellä ja vastata pyyntöihisi. Muuten kaiken Ohjelmaan liittyvän käyttäjätuen tarjoaa ensisijaisesti Samsung. Joissakin tapauksissa henkilötietojasi kuitenkin jaetaan kanssamme siinä määrin kuin se on tarpeen tietyn käyttäjätukiongelman ratkaisemiseksi.
• Ratkaistaksemme, oletko oikeutettu tilaamaan Laitteen. Ennen kuin Foxway hyväksyy tilauksesi koskien Laitetta, Foxway toteuttaa kolmannen osapuolen avustuksella luottotietojen tarkistuksen määrittääkseen, täytätkö kulloinkin voimassa olevat Laitteen tilaamista koskevat vaatimukset. Jos Foxwaylla on syytä epäillä petosta tai muuta laitonta tai haitallista toimintaa, pidätämme oikeuden pyytää lisää luottotietojesi tarkistuksia sopimusehtojen mukaisesti. Saamme tietoja vain siitä, oletko asiakkaana luottokelpoinen vai et.
• Sopimuksen päättymiseen liittyvät palautukset ja muistutukset. Käsittelemme yhteystietojasi tavoittaaksemme sinut Laitteen palauttamista koskevissa asioissa tai lähettääksemme muistutuksen ennen Ohjelman päättymistä, eli jotta voit päättää, haluatko ostaa tai palauttaa vuokratun      Laitteen tai vaihtoehtoisesti tehdä uuden sopimuksen kanssamme.
• Henkilötietojen anonymisointi tilastollisia tarkoituksia varten. Ohjelman tarjoamisen yhteydessä keräämämme henkilötiedot voidaan anonymisoida relevanttien kokonaistilastojen laatimista varten. Näitä tilastoja voidaan käyttää muun muassa palveluidemme kehittämiseen ja parantamiseen. Huomaa, että lopulliset anonymisoidut tiedot eivät sisällä henkilötietoja.
• Suojellaksemme meitä ja palveluitamme. Voimme käsitellä henkilötietojasi lakisääteisten vaatimusten täyttämiseksi, suojellaksemme oikeuksiamme sekä petosten ja muiden laittomien tai haitallisten toimien estämiseksi, jotka voivat vaikuttaa meihin, palveluihimme tai muihin asiakkaisiin.
• Mitä henkilötietoja käsittelemme?

Keräämämme tiedot riippuvat käyttämistäsi palveluista ja tiedoista, jotka päätät jakaa meille. Edellä kuvattuja tarkoituksia varten voimme käsitellä seuraavanlaisia meille antamiasi henkilötietoja:

• Yhteystiedot kuten nimi, sähköpostiosoite, osoite ja puhelinnumero.
• Henkilötunnus
• IP-osoite ja likimääräinen sijainti josta tilaus tehdään Laitteen tilauksen yhteydessä
• Muut tiedot, jotka annat meille kommunikoidessasi kanssamme, esimerkiksi Laitteen palautuksen käyttäjätuen tai Ohjelmaan liittyvän tiedustelusi yhteydessä.

Edellä mainittujen, meille jakamiesi tietojen lisäksi voimme kerätä ja tallentaa seuraavia henkilötietoja muista lähteistä:

Sopimuksen täytääntöönpano

Suurin osa edellä kuvatusta käsittelystä on tarpeen, jotta voimme tarjota Ohjelman ja täyttääksemme kanssasi tekemämme sopimuksen mukaiset velvoitteemme.

Intressivertailu

Jotkin käsittelytoimet perustuvat niin sanottuun intressivertailuun, mikä tarkoittaa, että meillä on oikeutettu etu käyttää tietoja tiettyyn tarkoitukseen. Jotta etua voidaan pitää lain mukaan oikeutettuna, eivät tarkoitus ja käsittely saa sivuuttaa perusoikeuksiasi tai -vapauksiasi. Kun käytämme henkilötietoja intressivertailuun perustuen, olemme arvioineet, että käyttö ei loukkaa oikeuksiasi tai vapauksiasi. Katsomme esimerkiksi, että meillä on oikeutettu etu kerätä luottotietoja kolmannen osapuolen välityksellä lain sallimissa tilanteissa, jotta voimme tehdä taloudellisen riskinarvioinnin koskien mahdollisuuttamme tehdä sopimus kanssasi.

Lakisääteinen velvoite

Edellä mainitun lisäksi meillä saattaa olla tarve kerätä ja säilyttää henkilötietoja myös noudattaaksemme tiettyjä meihin soveltuvia oikeudellisia velvoitteita.

Kuten tämän tietosuojakäytännön johdantokappaleessa on kuvattu, Foxwayn sopimuksen mukaisesti tarjoamassa Ohjelmassa on kyse Foxwayn ja Samsungin välisestä yhteistyöstä. Tämä tarkoittaa sitä, että henkilötietojasi voidaan jakaa yritysten välillä, jos ja siinä määrin kuin se on tarpeen Ohjelman tarjoamiseksi, esimerkiksi meneillään olevan käyttäjätukiongelman yhteydessä.

Muut toimittajat, jotka auttavat meitä tarjoamaan Ohjelmaa

Välillä meidän on myös tarpeen käyttää ulkopuolisia palveluntarjoajia Ohjelman tarjoamiseen. Käytämme ulkopuolisia toimittajia laskuttaessamme sinua Laitteesta ja hankkiessamme luottotietoja. Me valvomme aina alihankkijoidemme henkilötietojesi käyttöä ja vastaamme siitä.

Viranomaiset

Voimme jakaa henkilötietoja viranomaisille tai muille kolmansille osapuolille siinä tapauksessa, että laki tai asetukset sitä edellyttävät tai kun se on tarpeen meidän oikeuksiemme tai intressiemme tai käyttäjiemme, työntekijöidemme, johtajiemme tai osakkeenomistajiemme suojelemiseksi tai puolustamiseksi ja/tai palveluidemme turvallisuuden ylläpitämiseksi.

Sulautumisen tai yrityskaupan yhteydessä

Jos sulaudumme tai jos meidät myydään (kokonaan tai osittain), henkilötietosi jaetaan tai siirretään sulautumisessa syntyvälle taholle tai ostajataholle. Tällaisessa tapauksessa tietojesi käsittely jatkuu tämän tietosuojakäytännön mukaisesti.

• Miten suojaamme henkilötietojasi?

Toteutamme useita toimenpiteitä pitääksemme henkilötietosi turvassa ja suojattuina luvattomalta tai laittomalta käsittelyltä sekä tahattomalta häviämiseltä, tuhoutumiselta tai vahingoittumiselta. Suojaamme tietojasi sekä teknisin että organisatorisin toimenpitein valvomalla pääsyä ja valtuuksia sekä salausmenettelyjen avulla. Varmistamme myös, että ulkopuoliset alihankkijamme soveltavat asianmukaisia turvatoimia.

• Missä henkilötietojasi säilytetään?

Sinusta keräämiämme henkilötietoja käsitellään ja säilytetään pääasiassa EU:n alueella. Koska käytämme EU:n ulkopuolisiin maihin sijoittautuneita toimittajia, voidaan henkilötietojasi siirtää myös näihin maihin. Ennen henkilötietojen siirtämistä EU:n ulkopuolelle varmistamme, että henkilötietojesi suojaamiseksi on käytössä asianmukaiset suojatoimet, esimerkiksi käyttämällä Euroopan komission hyväksymiä vakiosopimuslausekkeita ja muita täydentäviä turvatoimia.

• Kuinka kauan säilytämme henkilötietojasi?

Kuinka kauan säilytämme henkilötietojasi, riippuu siitä, mihin tarkoitukseen tiedot on kerätty. Henkilötietojasi käsitellään niin kauan kuin on tarpeen sen tarkoituksen täyttämiseksi, jota varten ne on puolestamme kerätty. Tietojenkeruun tarkoitukset on esitetty kohdassa ”Miten käytämme henkilötietojasi?”.

Joissakin tapauksissa meidän on säilytettävä tietojasi pidempään soveltuvien lakien noudattamiseksi, riitojen ratkaisemiseksi ja oikeutettujen etujemme suojaamiseksi.

Haluamme myös informoida siitä, että jos yhteistyömme Samsungin kanssa päättyy, voi Samsung jatkaa henkilötietojesi käsittelyä Samsungin kulloinkin voimassa olevan tietosuojakäytännön mukaisesti.

1. Mitä oikeuksia sinulla on henkilötietojesi suhteen?

Sinulla on aina seuraavat henkilötietojasi koskevat oikeudet:

• Oikeus saada pääsy tietoihin (rekisteriote) – oikeus saada tietoa siitä, mitä henkilötietoja käsittelemme sinusta.
• Korjausoikeus – oikeus saada sinua koskevat epätarkat henkilötiedot korjattua.
• Oikeus tietojen poistamiseen – oikeus saada henkilötietosi poistettua tietyin edellytyksin.
• Oikeus rajoittaa tietojen käsittelyä – oikeus saada henkilötietojesi käsittely rajoitetuksi, kunnes virheelliset tiedot on oikaistu tai muut huomautukset on selvitetty.
• Oikeus tietojen siirrettävyyteen – oikeus pyytää henkilötietojen siirtoa rekisterinpitäjältä toiselle. Tämä oikeus rajoittuu tietoihin, jotka olet itse toimittanut meille.
• Vastustamisoikeus – oikeus vastustaa henkilötietojesi käsittelyä oikeutettujen etujemme perusteella (intressivertailu).

Voit käyttää edellä kuvattuja oikeuksiasi lähettämällä pyynnön osoitteeseen gdpr@foxway.com. Vastaamme pyyntöösi 30 päivän kuluessa. Huomaathan, että voi olla, että on olemassa vaatimuksia ja määräyksiä, jotka rajoittavat oikeuksiasi, esimerkiksi laki- tai sopimusperusteiset velvoitteet, jotka estävät meitä luovuttamasta, rajoittamasta tai poistamasta tietojasi.

Pyrimme aina käsittelemään kaikki tiedustelut ja valitukset lain mukaisesti, oikeudenmukaisesti ja avoimesti. Jos kuitenkin katsot, että oikeuksiasi on loukattu, voit tehdä valituksen asianomaiselle viranomaiselle (Suomessa tietosuojavaltuutetun toimisto https://tietosuoja.fi/etusivu), jos katsot, että meidän henkilötietojesi käsittelymme on soveltuvan lainsäädännön vastaista. 1. Muutokset ja päivitykset tähän tietosuojakäytäntöön

Saatamme tehdä muutoksia tähän tietosuojakäytäntöön. Voimassa oleva tietosuojakäytäntö on aina saatavilla verkkosivustollamme. Jos teemme olennaisia muutoksia, jotka vaikuttavat oikeuksiisi, ilmoitamme muutoksesta verkkosivustollamme tai sähköpostitse ennen kuin se tulee voimaan.
