Your privacy is our business. Foxway protects your privacy by making sure to collect and handle personal information in a responsible way. Our privacy policy takes dives deep into exactly how Foxway collects and uses your personal information. It’s highlighting your rights when it comes to personal data and how you can argue your rights. 

”Foxway”, ”we” ”our”, or ”us” refers to Foxway AB registered with the Swedish Companies Registration Office. Our organization number is 556470-0309 and our head office is at Grusåsvägen 7 in Växjö, Sweden. In accordance with EU data protection legislation, we are responsible for the personal data that you provided us with, or that we collected from you. All processing of your personal data by Foxway is done in accordance with applicable data protection legislation. 

Use of personal data as part of Samsung Flex

Personal data

Who is responsible for your personal data?

Foxway is responsible for the personal data collected and processed by us and our subcontractors within the framework of our services (the “Foxway Services”) and for the processing of personal data through our digital channels, such as this website and/or other future digital touchpoints.

Kinds of personal data processed

Personal data is information which helps to identify a person and therefore information that can be led back to a person. It includes name, telephone number, address, e-mail, username, profession and purchase history. Foxway also use cookies so that you do not have to log in every time you visit our website for example. More detailed information on how we use cookies can be found under the section ”Cookies” below. Please note that information about purchase history in relation to a specific corporate customer is linked to the corporate customer, and not to you as a contact person.

We can also collect person data from your device that can tell us if you are browsing from a computer or mobile phone and the browser that you are using. We also collect data on how you use Foxway Services, information about the features you use, the websites that you visit and the software configuration that you use. This may also include information about IP address and settings.

How do we collect your personal data?

We collect personal data when you use Foxway Services or in any other way interact with us. The data is collected through the following procedure:

Information that you share with us. When you register yourself as a user/customer, log in to our website and contact our customer service for support. When you sign up for our newsletter, one of our events, apply for a job with us or perform other activities within the framework of the Foxway Services when providing information about yourself, such as name, phone number, email address and content of messages. Personal data is usually provided by you actively providing us with filled out online forms, send emails or give us feedback through features created for that purpose. 

Some personal data is collected by analyzing the way you interact with Foxway Services and our products, such as website cookies and information (IP address, language settings and push notification settings) that we get from the way you use your device (mobile phone, computer or tablet) when using Foxway Services. 

What do we do with your data? 

The reason for processing personal data is to improve the Foxway Services for you. That we have the opportunity to (1) provide and administrate your access to Foxway Services, (2) fulfill our contractual and legal obligations, (3) to answer customer service issues, (4) improve your user experience, (5) send you information and direct marketing through email or any other way, (6) further develop the Foxway Services and (7) prevent, limit and investigate misuse of Foxway Services. 

The processing of personal data in accordance with points 1 to 3 above is done with fulfillment of an agreement as a legal basis (if the processing is necessary to fulfill our contractual obligations to you) or a legitimate interest. The processing of personal data in accordance with points 4 to 7 above is done with a legitimate interest as a legal basis, where Foxway’s legitimate interest is to be able to exercise its rights and obligations under the agreement with the customer company and to market our products and services.

How long do we store your personal data?

Foxway will take reasonable steps to store personal data only for as long as necessary in order to fulfill the purposes of which it was collected in the first place. Otherwise we will delete personal data in accordance with applicable law. We store your personal data for as long as it’s necessary for us to be able to fulfill our commitment, i.e. provide Foxway Services, invoice or handle complaints. If you have agreed that your contact information should be stored in our client register for marketing purposes, it will be stored up to 36 months after customer relationship has ended if you don’t request your personal data to be deleted before then.  

Who can we share your information with?

Foxway may share your personal data to partners who perform services on behalf of Foxway. These recipients only have the right to process your personal data in connection with performing a service for Foxway, e.g. to deliver an ordered item to you or to send marketing or newsletters. We require these providers to protect your personal information in accordance with this Privacy Policy and not use or disclose your personal information for any purpose other than to provide us with agreed products or services. We may also disclose your personal information to authorities, such as the Swedish Tax Agency, if we are required by law to do so. In the event that all or part of our business is sold, we may share your personal information to a potential buyer of the business.

Transaction to third countries

Foxway primarily processes personal data within the EU/EEA, but in some cases, use suppliers that are established in a third country (i.e. a country outside the EU/EEA), for data storage, and system maintenance that gives the supplier access to personal data. In the event that data is shared to suppliers in third countries, this will only happen when Foxway has legal support, e.g. by signing the European Commission’s standardized model clauses. Foxway will also require these providers to (1) protect your personal information in accordance with this Privacy Policy and (2) not use or disclose your personal information for any purpose other than to provide us with agreed products or services.

Security

Foxway takes all appropriate security measures necessary to protect your personal data from unauthorized access, alteration or destruction. However, it always involves a risk of disclosing personal data via digital channels as it is not entirely possible to protect computer systems from intrusion.

Your rights

You have the right to contact Foxway at any time in order to exercise your rights under applicable data protection laws.

The right to access extracts and correction: You have the right to request information free of charge once every calendar year about which (if any) personal data we process about you and also have any incorrect information corrected.

The right to be forgotten: You have the right to request the deletion of your personal data in the event that the data is no longer necessary for the purpose for which it was collected (the right to be forgotten). Depending on which data that gets deleted, Foxway may no longer be able to provide certain services to you.

The right to information: You have the right to receive information about how your personal data is processed. This is done through this Privacy Policy.

The right to limit the processing of your personal data: You have the right to limit the personal data. In such a case, the processing of your personal data may only take place for certain limited purposes.

Right to object against Foxway’s processing of personal data: You have the right to object to Foxway’s processing of your personal data under certain conditions. The right to object applies to e.g. if the processing is based on a balance of interests, unless we can demonstrate (1) compelling legitimate reasons for the processing that outweigh your interests, rights and libirties, or (2) if the processing takes place for the determination, exercise or defense of legal claims.

Right to object to marketing: You have the right to object Foxway’s processing your personal data for marketing. If you object to this, Foxway has to discontinue all marketing to you without undue delay. 

The right to data portability: You have the right to request a copy of the personal data you have provided to us in a structured, common and machine-readable format. You also have the right to request that Foxway share this personal data to another personal data controller. The right to data portability applies to personal data that is processed in an automated way, which is based on your consent or through an agreement to which you are a party.

External links

In our digital channels, there may be external links to other websites provided by other companies outside the Group. This privacy policy does not apply to these websites and you should therefore read the privacy policies of those websites before disclosing personal information.

What are cookies?

Cookies are small text files that are sent from our web server to be saved in your browser when you visit our website. The reason behind cookies is to improve your experience of our website. In your browser, you can change the settings for how cookies are allowed to be used or to ensure that cookies are always discarded when you close your browser.

How to delete cookies

Necessary cookies

These cookies are necessary for the website to function as intended and can’t be turned off in our systems. Necessary cookies are normally used only in response to activities that you have done in connection with a service request, for example when you make personal settings, log in or fill out a form. Foxway’s website can’t function optimally without these cookies.

Functional cookies

Functional cookies make it possible to save information that can change the appearance or functions of the website. In our forms on the website, we use the third-party tool Hubspot. Here we collect personal data about you to keep track of information that the visitor has provided in the form. That way we will have the opportunity to deliver more relevant information to the visitor.

Statistical cookies

Statistical cookies make it possible for Foxway to understand how our visitors interact with the website. We use Google Tag manager as a statistics tool for our website. Foxway uses it to be able to see the number of visitors to the website, where the visitor comes from and which sites have been visited. The information collected is anonymous.

Marketing cookies

Marketing cookies are used to track visitors cross-border on websites. These cookies contain information about how you interacted with our website. For example, which pages you visited and the links you clicked on. Our purpose is to show ads that are of interest to the individual user and that are more valuable to Foxway and third-party advertisers. Foxway uses targeted ads via the Google Marketing Platform, Facebook, instagram and Linkedin.

Foxways integritetspolicy för dig som användare av Samsung Flex

1. Introduktion

Denna integritetspolicy beskriver hur vi behandlar dina personuppgifter för att tillhandahålla programmet Samsung Flex (”Programmet“), när du kontaktar oss eller någon av våra samarbetspartners angående Programmet. Här kan du läsa mer om vilka personuppgifter vi samlar in, hur och varför vi använder dina personuppgifter och hur du tillvaratar dina rättigheter.

Notera att denna policy är specifik för Programmet och att vi även har en allmän integritetspolicy som beskriver Foxways övriga tjänster, bl.a. besökare av vår hemsida och affärskunder. Om du inte är användare av Programmet hänvisar vi till vår allmänna integritetspolicy som du hittar ovan.

Programmet är en tjänst för hyra och köp av mobila enheter (“Enhet”) inom ramen för Programmet som tillhandahålls av Foxway AB, Grusåsvägen 7, Växjö (556470-0309) (”Foxway”, ”vi”, ”oss”) genom ett samarbete mellan Foxway och Samsung Electronics Nordic AB, Torshamnsgatan 48, Kista (556445-4345) (”Samsung”). Foxway och Samsung är gemensamt personuppgiftsansvariga för den behandling av personuppgifter som sker inom ramen för Programmet. Foxway är huvudsakligen ansvarig för att hantera de personuppgifter som krävs för att kunna tillhandahålla och administrera Programmet. Samsung är huvudsakligen ansvarig för att behandla de personuppgifter som krävs för att erbjuda överenskommen support och besvara andra hårdvarurelaterade frågor.

Du kan vända dig till båda bolagen för alla frågor som rör användningen av dina personuppgifter. Detsamma gäller om du vill ha mer utförlig information om hur det gemensamma personuppgiftsansvaret är fördelat mellan Foxway och Samsung. • Vad är personuppgifter?

Med personuppgifter avses all information som kan användas för att identifiera dig, såsom ditt namn, personnummer, din adress, e-post, telefon eller e-postadress.

• Hur använder vi dina personuppgifter?

Vi kan komma att använda dina personuppgifter i följande syften.

• Tillhandahålla Programmet. Vi behöver behandla ett flertal personuppgifter, som ditt namn, personnummer och dina kontaktuppgifter för att uppfylla det avtal som vi har med dig om hyra av Enheten.
• Fakturering. Vi behandlar ditt namn, ditt personnummer och dina kontaktuppgifter för att skicka fakturor till dig enligt ingånget avtal.
• Kommunicera och tillhandahålla support. Vi behandlar dina kontaktuppgifter och information som du tillhandahåller i kommunikation med oss, för att kunna behandla och svara på dina förfrågningar. I övrigt tillhandahålls all support gällande Programmet i första hand av Samsung. Vid vissa fall kommer dock dina personuppgifter att delas med oss i den mån det är nödvändigt för att lösa ett specifikt supportärende.
• Avgöra om du har rätt att beställa Enhet. Innan din beställning av en Enhet godkänns kommer Foxway, med hjälp av tredje part, utföra en kreditupplysning på dig för att avgöra om du uppfyller vid var tid gällande krav för att beställa en Enhet. Om Foxway har anledning att misstänka bedrägeri eller andra olagliga eller skadliga aktiviteter, förbehåller vi oss rätten att under pågående avtalsrelation begära ytterligare kreditupplysningar. Vi får endast information om du som kund är kreditvärdig eller inte.
• Returer samt påminnelser i samband med avtalets upphörande. Vi behandlar dina kontaktuppgifter för att kunna nå ut till dig gällande retur av Enhet, eller med en påminnelse inför Programmets upphörande, dvs. för att du ska kunna ta ställning till om du vill köpa eller lämna tillbaka den hyrda Enheten alternativt ingå ett nytt avtal med oss.
• Anonymisering av personuppgifter för statistiska ändamål. Personuppgifter som samlas in av oss i samband med Programmets tillhandahållande kan komma att anonymiseras för att skapa relevant aggregerad statistik. Denna statistik kan bland annat användas för att för att utveckla och förbättra våra tjänster. Notera att den slutligt anonymiserade informationen inte kommer att innehålla några personuppgifter.
• Skydda oss och våra tjänster. Vi kan komma att behandla dina personuppgifter för att uppfylla lagkrav, skydda våra rättigheter samt förhindra bedrägeri och andra olagliga eller skadliga aktiviteter som kan påverka oss, våra tjänster eller andra kunder.
• Vilka personuppgifter kommer vi att behandla?

Vilken data vi samlar in om dig beror på vilka tjänster du använder och vilken data du väljer att dela med oss. För de ändamål vi beskrivit ovan kan vi behandla följande typer av personuppgifter som du tillhandahåller oss:

• Kontaktuppgifter såsom namn, e-post, adress och telefonnummer.
• Personnummer.
• IP-adress och ungefärlig plats som beställning görs ifrån i samband med beställning av Enhet.
• Övrig information som du förmedlar i kommunikation med oss, t.ex. i samband med support av retur av Enhet eller en förfrågan som du har till oss rörande Programmet.

Utöver de uppgifter ovan som du själv delar med oss, kan vi komma att inhämta och spara följande personuppgifter från andra källor:

• Kreditupplysningsinformation, som vi samlar in från Svea Bank.
• Varför använder vi din data?

Fullgörande av avtal

Merparten av de behandlingar som beskrivs ovan är nödvändiga för att vi ska kunna tillhandahålla Programmet och för att uppfylla vad vi har kommit överens om enligt vårt avtal med dig.

Intresseavvägning

Vissa behandlingar baseras på en så kallad intresseavvägning som innebär att vi har ett berättigat intresse att använda uppgifterna för ett visst ändamål. För att ett intresse ska anses vara berättigat enligt lag får ändamålet och behandlingen inte åsidosätta dina grundläggande rättigheter eller friheter. När vi använder personuppgifter baserat på en intresseavvägning har vi bedömt att användningen inte kommer att åsidosätta dina rättigheter eller friheter. Till exempel anser vi att vi har ett berättigat intresse av att samla in kreditupplysningsinformation via en tredje part för att kunna göra en finansiell riskbedömning av vår möjlighet att ingå avtal med dig.

Om du har ett användarkonto eller har på annat sätt varit i kontakt med oss kan vi även skicka nyhetsbrev till dig baserat på vårt berättigade intresse att marknadsföra våra tjänster. Du kan dock avbryta prenumerationen när som helst genom att följa länken “avregistrera” i nyhetsbrevet.

Rättslig förpliktelse

Utöver vad som anges ovan kan vi även behöva samla in och lagra personuppgifter för att kunna uppfylla vissa rättsliga skyldigheter som vi lyder under.

• Vem har åtkomst till dina personuppgifter?

Samsung Electronics Nordic AB

Som vi beskriver i denna policys inledande avsnitt utgör Programmet som Foxway tillhandahåller enligt ingånget avtal ett samarbete mellan Foxway och Samsung. Det innebär att dina personuppgifter kan komma att delas mellan bolagen om och i den mån det är nödvändigt för att tillhandahålla Programmet, t.ex. i samband med ett pågående supportärende.

Andra leverantörer som hjälper oss att tillhandahålla Programmet

Ibland är det även nödvändigt för oss att ta hjälp av externa tjänsteleverantörer för att kunna tillhandahålla Programmet. Vi använder externa leverantörer för att kunna fakturera dig för Enheten och för att inhämta kreditupplysningar. Vi kommer alltid att kontrollera och ansvara för våra underleverantörers användning av dina personuppgifter.

Myndigheter

Vi kan komma att dela personuppgifter med myndigheter eller andra tredje parter när det krävs enligt lag eller förordning eller när det är nödvändigt för att skydda eller försvara våra rättigheter och intressen, eller våra användare, anställda, styrelseledamöter eller aktieägare, och/eller för att upprätthålla säkerheten för våra tjänster.

Vid fusion, förvärv eller försäljning

Om vi skulle slås samman eller säljas (helt eller delvis), kommer dina personuppgifter att delas med eller överföras till den sammanslagna eller köpande enheten. I ett sådant fall kommer dina uppgifter att fortsätta att behandlas i enlighet med denna integritetspolicy.

• Hur skyddar vi dina personuppgifter?

Vi vidtar flera åtgärder för att hålla dina personuppgifter säkra och skyddade mot obehörig eller olaglig behandling och mot oavsiktlig förlust, förstörelse eller skada. Vi vidtar både tekniska och organisatoriska åtgärder för att skydda dina data genom åtkomstkontroll, behörighetskontroll och krypteringsprocedurer. Vi säkerställer också att våra tredjepartsleverantörer tillämpar lämpliga säkerhetsåtgärder.

• Var lagras dina personuppgifter?

De personuppgifter som vi samlar in om dig behandlas och lagras huvudsakligen inom EU. Eftersom vi använder oss av leverantörer som är etablerade i länder utanför EU kan dina personuppgifter även komma att överföras till dessa länder. Innan vi överför personuppgifter utanför EU säkerställer vi att lämpliga säkerhetsåtgärder finns på plats för att skydda dina personuppgifter, till exempel genom att använda de standardavtalsklausuler som godkänts av Europeiska kommissionen tillsammans med kompletterande säkerhetsåtgärder.

• Hur länge sparar vi dina personuppgifter?

Hur länge vi sparar dina personuppgifter varierar utifrån för vilket syfte vi samlade in uppgifterna. Dina personuppgifter används så länge det är nödvändigt för att uppfylla det syfte vi samlade in uppgifterna för. Syften med datainsamlingen anges under “Hur använder vi dina personuppgifter?”.

I vissa fall behöver vi lagra dina uppgifter längre för att följa tillämpliga lagar, möjliggöra tvistlösning samt för skydda våra berättigade intressen.

Vi vill även informera om att i det fall samarbetet mellan oss och Samsung upphör, kan Samsung fortsatt behandla dina personuppgifter i enlighet med Samsungs vid var tid gällande integritetspolicy.

1. Vilka rättigheter har du angående dina personuppgifter?

Du har alltid följande rättigheter i förhållande till dina personuppgifter:

• Rätt till tillgång (registerutdrag) – en rätt att få tillgång till information om vilka personuppgifter vi behandlar om dig.
• Rätt till rättelse – en rätt att få felaktiga personuppgifter om dig själv rättade.
• Rätt till radering – en rätt att få dina personuppgifter raderade under vissa förutsättningar.
• Rätt till begränsad behandling – en rätt att få behandlingen av dina personuppgifter begränsad tills oriktiga uppgifter har rättats eller annan invändning har utretts.
• Rätt till dataportabilitet – en rätt att kräva att personuppgifter flyttas från en personuppgiftsansvarig till annan. Denna rättighet är begränsad till uppgifter som du själv tillhandahållit oss.
• Rätt till invändning – en rätt att invända mot att dina personuppgifter behandlas med stöd av våra berättigade intressen (intresseavvägning).

Du kan utöva dina rättigheter som beskrivs ovan genom att skicka en begäran till gdpr@foxway.com. Vi kommer att svara på din förfrågan inom 30 dagar. Observera att det kan finnas krav och bestämmelser som begränsar dina rättigheter, till exempel kan det finnas skyldigheter enligt lag eller avtal som hindrar oss från att lämna ut, spärra eller radera dina uppgifter.

Vi avser alltid att hantera alla förfrågningar eller klagomål på ett lagligt, rättvist och öppet sätt. Om du ändå anser att dina rättigheter har åsidosatts kan du skicka in ett klagomål till relevant myndighet (i Sverige Integritetsskyddsmyndigheten https://www.imy.se) om du anser att vår behandling av dina personuppgifter strider mot tillämplig lagstiftning.
